Hesett App Terms and Conditions

Welcome to Hesett! These terms and conditions (“Terms”) govern your use of the Hesett mobile application (“App”) provided by Hesett Inc. (“we,” “us,” or “our”). By downloading, installing, or using the App, you agree to these Terms. If you do not agree to these Terms, please do not use the App.

1. Use of the App

1.1. Eligibility: You must be at least 18 years old to use the App. By using the App, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

1.2. Account Registration: To use certain features of the App, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

1.3. Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

1.4. Restrictions: You agree not to:

• Use the App for any illegal or unauthorized purpose.
• Interfere with or disrupt the operation of the App.
• Use the App to transmit any harmful or malicious code.
• Attempt to gain unauthorized access to the App or its related systems or networks.

2. Services Provided

2.1. Restaurant Listings: The App allows you to view and interact with listings for restaurants, bars, and nightclubs (“Establishments”).

2.2. Booking Tables: You can book tables at participating Establishments through the App.

2.3. QR Code Features: The App provides features for scanning QR codes at tables for menu translation, ordering, and real-time order tracking.

2.4. Direct Chat: You can use the App to chat directly with restaurant staff for service and support.

2.5. Payments and Orders: Payments and orders can only be initiated from within the premises of participating Establishments via QR code scan.

3. User Content

3.1. Content Submission: You may have the opportunity to submit content, such as reviews and feedback, through the App (“User Content”). You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, and display User Content in connection with the App.

3.2. Content Guidelines: You agree not to submit any User Content that is illegal, offensive, defamatory, or infringes on the rights of others. We reserve the right to remove any User Content that violates these guidelines.

4. Privacy

Your use of the App is subject to our Privacy Policy, which explains how we collect, use, and share your personal information. By using the App, you consent to our Privacy Policy.

5. Intellectual Property

The App and all content and materials included in the App, including but not limited to text, graphics, logos, and software, are the property of Hesett Inc. or its licensors and are protected by intellectual property laws. You agree not to reproduce, distribute, or create derivative works from any part of the App without our prior written consent.

6. Disclaimer of Warranties

The App is provided on an “as-is” and “as-available” basis. We make no warranties, express or implied, regarding the App, including but not limited to the accuracy, completeness, reliability, or availability of the App. Your use of the App is at your own risk.

7. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the App, even if we have been advised of the possibility of such damages.

8. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or in connection with your use of the App, your violation of these Terms, or your violation of any rights of another.

9. Modifications to the App and Terms

We reserve the right to modify or discontinue the App at any time without notice. We may also modify these Terms from time to time. Your continued use of the App after any such modifications constitutes your acceptance of the modified Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Hesett Inc. is headquartered, without regard to its conflict of law principles.
