Welcome to the Hesett Restaurant Dashboard (“Dashboard”) provided by Hesett Inc. (“we,” “us,” or “our”). These terms and conditions (“Terms”) govern your use of the Dashboard. By accessing or using the Dashboard, you agree to these Terms. If you do not agree to these Terms, please do not use the Dashboard.

1. Use of the Dashboard

1.1. Eligibility: You must be an authorized representative of a restaurant, bar, or nightclub (“Establishment”) to use the Dashboard. By using the Dashboard, you represent and warrant that you are authorized to bind the Establishment to these Terms.

1.2. Account Registration: To use the Dashboard, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

1.3. Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

1.4. Restrictions: You agree not to:

• Use the Dashboard for any illegal or unauthorized purpose.
• Interfere with or disrupt the operation of the Dashboard.
• Use the Dashboard to transmit any harmful or malicious code.
• Attempt to gain unauthorized access to the Dashboard or its related systems or networks.

2. Services Provided

2.1. Management Tools: The Dashboard provides tools for managing your Establishment’s profile, including menu updates, reservation management, and customer interactions.

2.2. Analytics: The Dashboard provides access to analytics and reports on customer interactions and reservations.

2.3. Communication: The Dashboard allows you to communicate with customers and manage their orders and inquiries.

3. Establishment Content

3.1. Content Submission: You may upload content to the Dashboard, such as menu items, photos, and promotional materials (“Establishment Content”). You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, and display the Establishment Content in connection with the Dashboard and the Hesett mobile application.

3.2. Content Guidelines: You agree not to submit any Establishment Content that is illegal, offensive, defamatory, or infringes on the rights of others. We reserve the right to remove any Establishment Content that violates these guidelines.

4. Privacy

Your use of the Dashboard is subject to our Privacy Policy, which explains how we collect, use, and share your personal information. By using the Dashboard, you consent to our Privacy Policy.

5. Intellectual Property

The Dashboard and all content and materials included in the Dashboard, including but not limited to text, graphics, logos, and software, are the property of Hesett Inc. or its licensors and are protected by intellectual property laws. You agree not to reproduce, distribute, or create derivative works from any part of the Dashboard without our prior written consent.

6. Disclaimer of Warranties

The Dashboard is provided on an “as-is” and “as-available” basis. We make no warranties, express or implied, regarding the Dashboard, including but not limited to the accuracy, completeness, reliability, or availability of the Dashboard. Your use of the Dashboard is at your own risk.

7. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Dashboard, even if we have been advised of the possibility of such damages.

8. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or in connection with your use of the Dashboard, your violation of these Terms, or your violation of any rights of another.

9. Modifications to the Dashboard and Terms
