Acceptance
By creating a Hesett account, scanning a QR code with the Hesett web app, or otherwise using any Hesett product, you agree to these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, do not use the service.
If you are using Hesett on behalf of a restaurant, hospitality group, or other organization (a “Partner”), you confirm that you have authority to bind that organization to these Terms.
Definitions
- Hesett: Hesett Technologies Inc., a Delaware corporation, with operating presence in Bogotá, Colombia.
- Service: the Hesett mobile app, web app, and back-end systems.
- Diner: a person who uses Hesett to view a menu, place an order, reserve a table, split a bill, or earn loyalty points.
- Partner: a restaurant or hospitality business that uses Hesett to take orders, manage reservations, or process payments.
Accounts
You can use Hesett without an account in “guest mode” from the web app. Creating a mobile account is required only if you want loyalty points, reservations, persistent dining groups, or saved payment methods.
You are responsible for keeping your credentials confidential and for everything that happens under your account. Notify us immediately at support@hesett.com if you suspect unauthorized access.
How you may use Hesett
You may not, and may not permit anyone to:
- Use Hesett for any unlawful purpose, including fraud, harassment, or money-laundering.
- Reverse-engineer, decompile, or attempt to extract source code from any part of the Service, except where local law expressly permits this and you have given us 30 days written notice.
- Scrape menus, prices, restaurant data, or any other content from the Service without our written permission.
- Submit false orders, refuse to pay for placed orders, or use stolen payment methods.
- Probe, attack, or stress-test the Service. Vulnerability reports are very welcome — see our Security page.
Orders and reservations
When you place an order or make a reservation through Hesett, the contract for that meal is between you and the restaurant, not between you and Hesett. Hesett facilitates the transaction; the restaurant is responsible for the food, service, and any disputes about either.
Orders are normally final once accepted by the kitchen. If you need to modify or cancel, do so immediately from the order screen. After a dish has been fired, modifications are at the restaurant's discretion.
Payments and refunds
Card payments are processed by Stripe. By placing a paid order, you authorize Stripe to charge the payment method you select. Receipts are emailed to you and saved in your order history.
Refund requests should go to the restaurant first, because they hold the funds. If the restaurant agrees to a refund, it is issued back to the original payment method within 5–10 business days. Hesett mediates if the restaurant is unresponsive — write to support@hesett.com.
Restaurant partners
Restaurant Partners use Hesett under a separate Partner Agreement that covers commercial terms, payouts, and operational responsibilities. Partners are responsible for the accuracy of their menus (prices, allergens, descriptions), the food they serve, the staff they employ, and applicable health and safety regulations.
Intellectual property
The Hesett name, logo, brand, app, designs, source code, and all related materials are owned by Hesett Technologies Inc. and protected by trademark and copyright law. The Terms grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service — nothing else.
Restaurant Partners retain ownership of their menus, photography, and content they upload to Hesett. They grant Hesett a worldwide license to display, translate, and reproduce that content within the Service.
Your content
Reviews, ratings, photos, and notes you submit through Hesett remain yours. You grant Hesett a worldwide, royalty-free license to display, distribute, and translate that content within the Service and in marketing materials. You can revoke this license at any time by deleting the content from your account.
You agree not to post content that is unlawful, defamatory, hateful, or that infringes anyone else's intellectual property.
Liability
Hesett is provided “as is.” To the maximum extent permitted by applicable law, Hesett Technologies Inc. is not liable for indirect, incidental, consequential, or punitive damages, lost profits, or lost data arising from your use of the Service.
Our total aggregate liability to you for any claim arising from these Terms is capped at the greater of (a) the total amounts you paid Hesett in the 12 months before the event giving rise to the claim, or (b) US $100.
Nothing in these Terms excludes or limits liability that cannot legally be excluded — including liability for fraud, gross negligence, or wilful misconduct.
Termination
You can terminate your account at any time by deleting it from Settings or by writing to us. We can suspend or terminate accounts that violate these Terms, with notice where reasonably possible. Sections that should survive termination — payments owed, IP, liability — do.
Changes
We update these Terms occasionally. Material changes are announced at least 30 days in advance by email or in-app banner. Continued use after the effective date constitutes acceptance.
Governing law
These Terms are governed by the laws of the State of Delaware, United States of America, without regard to its conflict-of-laws principles. Disputes are submitted to the state or federal courts located in Delaware, unless mandatory law assigns them elsewhere — for example, the courts of the consumer's habitual residence under EU consumer law, or Colombian courts for disputes that arise from local operations and consumer-protection statutes that cannot be waived.
